Introduction
[1] This is an opposition brought by Qingdao Ecopure Filter Co., Ltd (the Opponent) in respect of application number 2,154,711 filed by Waterdrop Microdrink GmbH (the Applicant) for the trademark WATERDROP (the Mark).
[2] The Mark is applied for in association with “Apparatus for aerating water, namely, water treatment unit for aerating water for preparing soda water” (the Goods).
[3] The primary issue in this proceeding is whether the Mark is confusing with the Opponent’s WATERDROP and other WATERDROP-formative trademarks (collectively, the Opponent’s Marks).
[4] For the reasons set out below, the application is refused.
The Record
[5] The application for the Mark was filed on November 18, 2021 and was advertised for opposition purposes in the Trademarks Journal dated April 10, 2024.
[6] On May 9, 2024, the Opponent filed its statement of opposition under section 38 of the Trademarks Act, RSC 1985, c T 13 (the Act).
[7] The Opponent bases the opposition on sections 38(2)(b) and 12(1)(d) (not registrable due to confusion with the Opponent’s registered trademarks), 38(2)(c) and 16 (non-entitlement to registration), and 38(2)(d) and 2 (non-distinctiveness) of the Act.
[8] The Applicant filed a counterstatement refuting the grounds of opposition.
[9] In support of its opposition, the Opponent filed the affidavit of Jing Han, sworn November 7, 2024 (the Han Affidavit).
[10] The Applicant filed a notice indicating it did not wish to file evidence.
[11] The Opponent filed written representations. No oral hearing was held.
Overview of the Evidence
[12] The only evidence filed in this proceeding is the Han Affidavit filed by the Opponent.
[13] Ms. Han is the Compliance Manager of the Opponent [para 1].
[14] The Han Affidavit contains, inter alia, the following statements, information, and exhibits:

The Opponent was previously the licensed manufacturer and distributor of the products sold under the Opponent’s Marks and acquired the ownership of rights, both at common law and as registered, in the Opponent’s Marks in 2021 [para 5]. Full details of the Opponent’s Marks are attached as Schedule A.

The Opponent and its predecessors-in-title have expended substantial time, money, and resources marketing, advertising, and promoting the water filters sold under the Opponent’s Marks [para 8].

The Opponent, a Chinese limited company, is a manufacturer of replacement water filters. Its business centres around the manufacture and sale of water filters which includes various types of filters including hundreds of models of under sink water filters, countertop filters, outdoor filters, water tap filters, fridge filters and air filters [paras 10 and 12].

The Opponent’s filters are water treatment filters designed to filter out contaminants and other undesirable particles from water to result in safe, clean water for drinking or use in cooking [para 11].

The Opponent has been in business for over ten years selling its products world wide, including in Canada, where sales have been primarily through online sales on Amazon and eBay [paras 13,14 and 15]. Screenshots of the Opponent’s Canadian Amazon store are attached as Exhibit B.

The Opponent and/or its predecessors-in-title have used the WATERDROP trademark (the Opponent’s WATERDROP Mark) in Canada since at least April 1, 2018, this being the date of the first sale of water filters to a Canadian address. These filters had the Amazon Standard Identification Number (ASIN) B01GACANRG [paras 16 and 17].

Attached as Exhibit C is printout of the current sale page for the Opponent’s water filters associated with the Opponent’s WATERDROP Mark, ASIN B01GACANRG, showing that the filter has been listed for sale on Amazon since at least January 21, 2017 [para 19].

Prior to November 2021, the Opponent sold at least 39,000 water filters branded with the Opponent’s WATERDROP Mark through Amazon into Canada [para 21].

Based on Ms. Han’s review of the Opponent’s records, the aggregate sales of the Opponent’s water filters branded with the Opponent’s WATERDROP Mark in and into Canada between 2018 and 2024 are in excess of $14 million CAD [para 22].

The current average retail selling price of refrigerator water filters associated with the Opponent’s WATERDROP Mark in Canada is in the range of $11-$17 CAD per unit [para 23].
Evidential Burden and Legal Onus
[15] In accordance with the usual rules of evidence, there is an evidential burden on the Opponent to prove the facts inherent in its allegations pleaded in the statement of opposition [John Labatt Ltd v Molson Companies Ltd, 1990 CanLII 11059, CarswellNat 1053 (FC)]. The presence of an evidential burden on the Opponent with respect to a particular issue means that in order for the issue to be considered at all, there must be sufficient admissible evidence from which it could reasonably be concluded that the facts alleged to support that issue exists [John Labatt at 298].
[16] For those allegations for which the Opponent has met its evidential burden, the legal onus is on the Applicant to show that the application does not contravene the provisions of the Act as alleged in the statement of opposition. The presence of a legal onus on the Applicant means that, if a determinate conclusion cannot be reached once all the evidence has been considered, then the issue must be decided against it.
Assessment of Grounds of Opposition
Section 38(2)(b) and 12(1)(d) Ground – Confusion with Registered Trademarks
[17] The Opponent pleads that the Mark is not registrable as it is confusing with registration nos. TMA1,164,175, TMA1,181,315, and TMA1,181,316 for the trademarks WATERDROP, WATERDROP ELFIN and WATERDROP LUCID (collectively, the Opponent’s Registered Marks).
[18] The relevant date for this ground of opposition is the date of my decision [Park Avenue Furniture Corp v Wickers/Simmons Bedding Ltd (1991), 37 CPR (3d) 413 (FCA)].
[19] An opponent’s initial burden is met with respect to a section 12(1)(d) ground of opposition if the registration(s) relied upon remain in good standing as of the date of the opposition decision. I have exercised my discretion to check the register and confirm that registrations TMA1,164,175, TMA1,181,315, and TMA1,181,316 for the Opponent’s Registered Marks remain extant [see Quaker Oats Co of Canada v Menu Foods Ltd, 1986 CanLII 7700 (TMOB), 11 CPR (3d) 410]. I therefore find that the Opponent has satisfied its evidential burden for this ground. I must now assess whether the Applicant has met its legal onus.
[20] In determining whether two trademarks are confusing, all the surrounding circumstances should be considered, including those listed in section 6(5) of the Act: the inherent distinctiveness of the trademarks and the extent to which they have become known; the length of time the trademarks have been in use; the nature of the goods and services or business; the nature of the trade; and the degree of resemblance between the trademarks, including in appearance or sound or in the ideas suggested by them. These criteria are not exhaustive and different weight will be given to each one in a context specific assessment [Mattel, Inc v 3894207 Canada Inc, 2006 SCC 22 at para 54; Veuve Clicquot Ponsardin v Boutiques Cliquot Ltée, 2006 SCC 23]. I also refer to Masterpiece Inc v Alavida Lifestyles Inc, 2011 SCC 27 at para 49, where the Supreme Court of Canada states that section 6(5)(e), the degree of resemblance between the trademarks, will often have the greatest effect on the confusion analysis.
[21] The test for confusion is assessed as a matter of first impression in the mind of a casual consumer somewhat in a hurry who sees the applicant’s mark, at a time when they have no more than an imperfect recollection of the opponent's trademark, and do not pause to give the matter any detailed consideration or scrutiny, nor to examine closely the similarities and differences between the marks [Veuve Clicquot at para 20].
[22] As the Opponent’s Registered Marks are all registered with nearly identical goods, and considering the Opponent’s registered WATERDROP trademark (previously defined as the Opponent’s WATERDROP Mark) is identical to the Mark, I consider it to represent the Opponent’s best chance to succeed on this ground. If the Mark is not found to be confusing with the Opponent’s WATERDROP Mark, it will not be confusing with the other two of the Opponent’s Registered Marks.
Inherent Distinctiveness and Extent Known
[23] As the Mark and the Opponent’s WATERDROP Mark are identical and are both at least somewhat suggestive of the respective associated goods, being goods used for the treatment of water, I consider both to have limited inherent distinctiveness, with neither party being favoured.
[24] Regarding extent known, the Opponent has provided evidence of use and sales in Canada of water filters associated with the Opponent’s WATERDROP Mark since 2018 and has evidenced sales in Canada of these goods of $14 million CAD from 2018 to 2024. Based on this evidence I am able to conclude that the Opponent’s WATERDROP Mark has become known to at least some extent in Canada.
[25] As the Applicant has filed no evidence of use of the Mark, I am unable to conclude it has become known to any extent in Canada.
[26] The Opponent is therefore favoured by this factor.
Length of Time in Use
[27] The Opponent’s evidence establishes that it has used the WATERDROP Mark in Canada since at least April 1, 2018.
[28] As the Applicant has not filed any evidence of use of the Mark in this proceeding, this factor favours the Opponent.
Nature of the Goods, Services or Business
[29] The Opponent submits that the goods of both parties can generally be described as water treatment units relating to drinking water, although the Applicant’s are used to aerate water while the Opponent’s are for filtering water [written representations, para 33]. Given that both the Opponent’s and Applicant’s products are consumer products relating to drinking water, generally expected to be found in consumer kitchens, the Opponent submits that there is “almost complete overlap” between the goods of the parties.
[30] I agree with the Opponent that the goods of both parties fall within the same general category of consumer water treatment units and am of the view that, as a result, the goods of the parties are sufficiently similar that overlap of the goods is at least plausible.
[31] This factor therefore favours the Opponent.
Nature of the Trade
[32] Given that I have concluded that there is at least a plausible overlap between the goods of the parties, and considering the Applicant has filed no evidence or argument to suggest the trades of the parties differ, I consider it reasonable to conclude that it is also plausible that the trades of the parties also overlap to some extent.
[33] Accordingly, this factor also favours the Opponent.
Degree of Resemblance
[34] In the present case, the Mark and the Opponent’s WATERDROP registered trademark are identical.
[35] This factor therefore clearly favours the Opponent.
Conclusion on Confusion
[36] Having regard to the foregoing, I find that the Applicant has not met its legal onus to show that, on a balance of probabilities, it is not reasonably likely that an individual who has an imperfect recollection of the Opponent’s WATERDROP Mark, would not, as a matter of first impression and imperfect recollection, conclude that the Applicant’s Goods share a common source. I make this finding given that, with the exception of inherent distinctiveness for which neither party is favoured, all of the surrounding circumstances favour the Opponent.
[37] This ground of opposition is therefore successful.
Section 38(2)(c) and 16(1)(a) Ground – Confusion with Previously Used Trademark
[38] The Opponent submits that the Applicant is not the person entitled to registration of the Mark as, as of the date of filing (being the relevant date for this ground), the Mark was confusing with the Opponent’s WATERDROP Mark which had previously been used or made known in Canada in association with various water filtration units and water filters including the following:
domestic water jug filters, drinking water filter cartridges, faucet filters, reverse osmosis membrane filters for water treatment, reverse osmosis water filtration units, apparatus for filtering drinking water, countertop water filters, namely, water canisters sold empty, water filters for faucets, water filters in the nature of water purifiers; water filtration bottles sold empty; water filtration pitchers sold empty, water treatment equipment, namely, reverse osmosis filtration units, water filtration and purification units and replacement cartridges and filters therefor for refrigerators
[39] However, the only evidence of sales in Canada of goods associated with the Opponent’s WATERDROP Mark is for the goods having the ASIN B01GACANRG [Han Affidavit, para 17]. Exhibit C of the Han Affidavit contains the current Amazon page offering ASIN B01GACANRG for sale and describes this product as a replacement refrigerator water filter. Therefore, although the Opponent asserts use of the Opponent’s WATERDROP Mark with a variety of water filtration units and water filters in Canada, it has only provided evidence of use with, and can therefore only rely on use with, replacement refrigerator water filters for the purposes of this ground.
[40] In its written representations, the Opponent relies on the same submissions in respect of the section 6(5) factors as the section 12(1)(d) ground assessed above.
[41] While the earlier material date for this ground does not significantly affect my assessment of the section 6(5) factors as set out in the section 12(1)(d) ground, I must consider the factors of nature of the goods and business, and nature of the trade in light of the Opponent’s goods for this ground being limited to replacement refrigerator water filters, instead of the full list of goods contained in the registration for the Opponent’s WATERDROP Mark.
Nature of the Goods, Services or Business
[42] The Opponent’s submissions in respect of this factor are that the goods of both parties can generally be described as water treatment units relating to drinking water [written representations, para 33]. However, as the Opponent can only rely on the goods replacement refrigerator water filters for this ground, this argument does not apply.
[43] In my view, it is not clear that replacement water filters specifically for use in refrigerators are sufficiently similar to the Applicant’s “Apparatus for aerating water, namely, water treatment unit for aerating water for preparing soda water” to result in the Opponent being favoured by this ground. However, since there is no limitation on the potential uses for Applicant’s Goods set out in the application for the Mark, it is possible the Goods could be integrated into refrigerators and therefore used in close proximity of the Opponent’s replacement refrigerator water filters. As a result, while I am unable to conclude that there is an overlap in the goods of the parties, I do consider it possible that the goods of the parties could be used in conjunction with each other.
[44] Accordingly, I find this factor favours the Opponent.
Nature of the Trade
[45] Given that I have concluded that there is at least a possible connection between the goods of the parties, in that they may well both be used in water filtration/processing units in refrigerators, and considering the Applicant has filed no evidence or arguments to suggest the trades of the parties differ, I consider it reasonable to conclude that it is also plausible that the trades of the parties are the same or similar.
[46] Accordingly, this factor also favours the Opponent.
Conclusion on Confusion
[47] Having considered all the surrounding circumstances as assessed above in respect of the section 12(1)(d) ground, and the reassessment of the section 6(5) factors affected by the limited goods with which the Opponent has evidenced use in Canada as of the filing date of the application for the Mark, the Opponent succeeds in respect of this ground as well.
Remaining Grounds of Opposition
[48] As the Opponent has already succeeded in respect of two grounds of opposition, I do not consider it necessary to assess the remaining grounds of opposition.
Disposition
[49] Pursuant to the authority delegated to me under section 63(3) of the Act, I refuse the application pursuant to section 38(12) of the Act.
